INTERPOL states that a Red Notice is not an international arrest warrant, but a request made to locate a person and provisionally arrest them for the purpose of extradition, surrender, or similar legal action.<\/p>\n<h2 data-end=\"1116\" data-section-id=\"1qa97hn\" data-start=\"1086\">What Is Detention at the Airport?<\/h2>\n<p data-end=\"1350\" data-start=\"1118\">Detention at the airport refers to the process in which a person is stopped by law enforcement units and referred to judicial authorities due to a record concerning them during passport control, entry into the country, departure from the country, or transit.<\/p>\n<p data-end=\"1399\" data-start=\"1352\">These records may arise from different reasons:<\/p>\n<ul>\n<li data-end=\"1664\" data-start=\"1401\">Domestic arrest warrant<\/li>\n<li data-end=\"1664\" data-start=\"1401\">Search record issued by a court or prosecutor\u2019s office<\/li>\n<li data-end=\"1664\" data-start=\"1401\">INTERPOL Red Notice<\/li>\n<li data-end=\"1664\" data-start=\"1401\">Diffusion message<\/li>\n<li data-end=\"1664\" data-start=\"1401\">Foreign state\u2019s provisional arrest request<\/li>\n<li data-end=\"1664\" data-start=\"1401\">File awaiting extradition documents<\/li>\n<li data-end=\"1664\" data-start=\"1401\">Restriction code or deportation record<\/li>\n<li data-end=\"1664\" data-start=\"1401\">Finalized sentence enforcement record<\/li>\n<\/ul>\n<p data-end=\"1948\" data-start=\"1666\">However, not every airport stop leads to the same result. In some cases, the person may be released after a brief identity and record check. In some cases, they are referred to the prosecutor\u2019s office or a judgeship. In some extradition files, provisional arrest or judicial control may arise.<\/p>\n<h2 data-end=\"2002\" data-section-id=\"1prp0s2\" data-start=\"1950\">Are Arrest and Detention at the Airport the Same Thing?<\/h2>\n<p data-end=\"2263\" data-start=\"2004\">Arrest, detention, and pre-trial detention are different legal procedures. At the airport, a person may first be stopped or arrested by law enforcement. Then, the prosecutor\u2019s office may decide on release, detention, referral to a judicial authority, or another procedure.<\/p>\n<p data-end=\"2488\" data-start=\"2265\">Arrest is the initial restriction of the person\u2019s liberty. Detention is a temporary measure applied by the prosecutor\u2019s decision to complete investigation procedures. Pre-trial detention is applied by a judge or court decision.<\/p>\n<p data-end=\"2830\" data-start=\"2490\">According to the Regulation on Arrest, Detention, and Taking Statements, the detention period may not exceed twenty-four hours from the moment of arrest, excluding the mandatory time required to send the person to the nearest judge or court; the mandatory time required for such transfer may not exceed twelve hours.<\/p>\n<h2 data-end=\"2883\" data-section-id=\"q1l5lm\" data-start=\"2832\">Being Stopped at the Airport Due to an INTERPOL Record<\/h2>\n<p data-end=\"3144\" data-start=\"2885\">One of the most common situations encountered at the airport is that the person is subject to an INTERPOL Red Notice or diffusion message. In this case, the person may be stopped at passport control and processed by law enforcement units for examination of the relevant record.<\/p>\n<p data-end=\"3503\" data-start=\"3146\">The Ministry of Justice describes a Red Notice as a notice issued by the INTERPOL General Secretariat for the arrest, for extradition purposes, of suspects, defendants, or convicted persons wanted by the judicial authorities of a country wherever they are found, containing the person\u2019s identity information and judicial information regarding the alleged offense.<\/p>\n<p data-end=\"3853\" data-start=\"3505\">A diffusion message, similar to a Red Notice, is a faster search notification sent by the relevant country\u2019s INTERPOL unit to other countries. According to the Ministry of Justice\u2019s explanation, a diffusion message may be sent to prevent delay because issuing a Red Notice may take time.<\/p>\n<h2 data-end=\"3909\" data-section-id=\"12g3yrp\" data-start=\"3855\">Is a Red Notice a Ground for Arrest at the Airport?<\/h2>\n<p data-end=\"4239\" data-start=\"3911\">A Red Notice is not, by itself, a definitive ground for arrest. The existence of a Red Notice may lead to locating the person and evaluating temporary measures in terms of the extradition process. However, in Turkey, legal conditions must also be met for an arrest, provisional arrest, or judicial control order to be issued.<\/p>\n<p data-end=\"4444\" data-start=\"4241\">INTERPOL clearly states that a Red Notice is not an international arrest warrant. Member states attach consequences to Red Notices according to their own domestic law.<\/p>\n<p data-end=\"4549\" data-start=\"4446\">Therefore, the following matters should be examined for a person stopped at the airport due to a Red Notice:<\/p>\n<ul>\n<li data-end=\"5008\" data-start=\"4551\">The arrest warrant or court decision on which the Red Notice is based<\/li>\n<li data-end=\"5008\" data-start=\"4551\">The nature of the offense alleged by the requesting country<\/li>\n<li data-end=\"5008\" data-start=\"4551\">Whether the act is also considered a crime under Turkish law<\/li>\n<li data-end=\"5008\" data-start=\"4551\">Whether the person is a Turkish citizen<\/li>\n<li data-end=\"5008\" data-start=\"4551\">Whether the request is political in nature<\/li>\n<li data-end=\"5008\" data-start=\"4551\">Whether the extradition documents have reached Turkey<\/li>\n<li data-end=\"5008\" data-start=\"4551\">Whether the conditions for provisional arrest have been met<\/li>\n<li data-end=\"5008\" data-start=\"4551\">Whether judicial control measures would be sufficient<\/li>\n<li data-end=\"5008\" data-start=\"4551\">Whether there is a human rights or ill-treatment risk<\/li>\n<\/ul>\n<h2 data-end=\"5049\" data-section-id=\"1u6youc\" data-start=\"5010\">What Is Provisional Arrest at the Airport?<\/h2>\n<p data-end=\"5321\" data-start=\"5051\">A provisional arrest order may be issued for a person arrested at the airport due to a foreign state\u2019s extradition request or a Red Notice record. Provisional arrest is a protective measure applied to prevent the person from fleeing before the extradition documents have reached Turkey.<\/p>\n<p data-end=\"5638\" data-start=\"5323\">According to the Ministry of Justice\u2019s explanation, a state that determines that a person wanted on the basis of a Red Notice or diffusion message is present in its territory may, if it deems necessary, ensure that the person is provisionally arrested and then request that the requesting state transmit the extradition request.<\/p>\n<p data-end=\"5918\" data-start=\"5640\">Within the scope of Law No. 6706, provisional arrest or judicial control may be applied for the purpose of extradition. If the extradition documents are not sent within the period determined by the relevant state, the provisional arrest or judicial control order must be lifted.<\/p>\n<h2 data-end=\"5972\" data-section-id=\"1vstpp2\" data-start=\"5920\">Is a Person Arrested at the Airport Extradited Immediately?<\/h2>\n<p data-end=\"6144\" data-start=\"5974\">No. A person arrested at the airport is not immediately surrendered to the foreign state even if there is a Red Notice or extradition request. A separate legal process for extradition is conducted in Turkey.<\/p>\n<p data-end=\"6193\" data-start=\"6146\">The extradition process generally consists of the following stages:<\/p>\n<ul>\n<li data-end=\"6693\" data-start=\"6195\">The person is stopped or arrested at the airport<\/li>\n<li data-end=\"6693\" data-start=\"6195\">Record and identity information is examined<\/li>\n<li data-end=\"6693\" data-start=\"6195\">The prosecutor\u2019s office or judgeship process begins<\/li>\n<li data-end=\"6693\" data-start=\"6195\">Provisional arrest or judicial control is evaluated<\/li>\n<li data-end=\"6693\" data-start=\"6195\">Extradition documents are awaited from the requesting state<\/li>\n<li data-end=\"6693\" data-start=\"6195\">If the extradition documents arrive, the file is sent to the high criminal court<\/li>\n<li data-end=\"6693\" data-start=\"6195\">The court examines whether the extradition request is admissible<\/li>\n<li data-end=\"6693\" data-start=\"6195\">Legal remedies against the decision are evaluated<\/li>\n<li data-end=\"6693\" data-start=\"6195\">If the acceptance decision becomes final, the administrative approval and surrender process is carried out<\/li>\n<li data-end=\"6858\" data-start=\"6695\">Therefore, the initial arrest at the airport may be only the beginning of the extradition process. The actual decision is made as a result of the court\u2019s examination of the extradition conditions.<\/li>\n<\/ul>\n<h2 data-end=\"6903\" data-section-id=\"hy7230\" data-start=\"6860\">How Long Is the Detention Period at the Airport?<\/h2>\n<p data-end=\"7214\" data-start=\"6905\">If general criminal procedure provisions apply to the person arrested at the airport, the detention period may generally not exceed twenty-four hours from the moment of arrest. The mandatory time required to send the person to the nearest judge or court may not exceed twelve hours.<\/p>\n<p data-end=\"7553\" data-start=\"7216\">However, in extradition files, the process may not be limited only to the ordinary detention period. After the person is brought before the prosecutor\u2019s office or judgeship, they may face a provisional arrest or judicial control order for the purpose of extradition. Therefore, the process that begins at the airport may turn into extradition proceedings before the high criminal court depending on the nature of the file.<\/p>\n<h2 data-end=\"7612\" data-section-id=\"te8brl\" data-start=\"7555\">Can Judicial Control Be Applied Instead of Provisional Arrest?<\/h2>\n<p data-end=\"7775\" data-start=\"7614\">Yes. In extradition files, judicial control may be applied instead of provisional arrest. Judicial control means applying lighter measures to prevent the person from fleeing.<\/p>\n<p data-end=\"7832\" data-start=\"7777\">The following measures may arise within the scope of judicial control:<\/p>\n<ul>\n<li data-end=\"8056\" data-start=\"7834\">Ban on leaving the country<\/li>\n<li data-end=\"8056\" data-start=\"7834\">Obligation to sign in at regular intervals<\/li>\n<li data-end=\"8056\" data-start=\"7834\">Residing at a specified address<\/li>\n<li data-end=\"8056\" data-start=\"7834\">Depositing security<\/li>\n<li data-end=\"8056\" data-start=\"7834\">Restrictions concerning a passport or travel document<\/li>\n<li data-end=\"8056\" data-start=\"7834\">Other obligations deemed appropriate by the court<\/li>\n<\/ul>\n<p data-end=\"8252\" data-start=\"8058\">In a request for judicial control, the person\u2019s fixed residence, family ties, health condition, employment status, social relations in Turkey, whether the risk of flight is concrete, and the status of the extradition documents are important.<\/p>\n<h2 data-end=\"8295\" data-section-id=\"nmhlbg\" data-start=\"8254\">Rights of a Person Arrested at the Airport<\/h2>\n<p data-end=\"8461\" data-start=\"8297\">A person arrested or detained at the airport has fundamental rights. The exercise of these rights is particularly important in extradition and Red Notice files.<\/p>\n<p data-end=\"8497\" data-start=\"8463\">The person\u2019s main rights are as follows:<\/p>\n<ul>\n<li data-end=\"8843\" data-start=\"8499\">Right to learn the reason for arrest<\/li>\n<li data-end=\"8843\" data-start=\"8499\">Right to meet with a lawyer<\/li>\n<li data-end=\"8843\" data-start=\"8499\">Right to request that relatives be notified<\/li>\n<li data-end=\"8843\" data-start=\"8499\">Right to request an interpreter<\/li>\n<li data-end=\"8843\" data-start=\"8499\">Right to remain silent<\/li>\n<li data-end=\"8843\" data-start=\"8499\">Right to undergo a medical examination<\/li>\n<li data-end=\"8843\" data-start=\"8499\">Right to object to the arrest or detention procedure<\/li>\n<li data-end=\"8843\" data-start=\"8499\">Right to object to the provisional arrest order<\/li>\n<li data-end=\"8843\" data-start=\"8499\">Right to request judicial control<\/li>\n<li data-end=\"8843\" data-start=\"8499\">Right to present a defense in extradition proceedings<\/li>\n<\/ul>\n<p data-end=\"9094\" data-start=\"8845\">The first procedures carried out at the airport may affect the extradition proceedings that will be conducted later. Therefore, it is important to obtain legal support before giving a statement, signing documents, or making declarations that may produce consequences such as consent-based extradition.<\/p>\n<h2 data-end=\"9149\" data-section-id=\"4jjb68\" data-start=\"9096\">Should Consent-Based Extradition Be Accepted at the Airport?<\/h2>\n<p data-end=\"9439\" data-start=\"9151\">Consent-based extradition means that the person agrees to be surrendered to the requesting state during the extradition process. However, this declaration may have serious legal consequences. Therefore, statements made at the airport under fatigue, panic, language difficulties, or lack of information should be evaluated carefully.<\/p>\n<p data-end=\"9508\" data-start=\"9441\">Before accepting consent-based extradition, the following matters should be examined:<\/p>\n<ul>\n<li data-end=\"9865\" data-start=\"9510\">Which offense the requesting country alleges<\/li>\n<li data-end=\"9865\" data-start=\"9510\">Whether the person is a Turkish citizen<\/li>\n<li data-end=\"9865\" data-start=\"9510\">Whether the extradition request is lawful<\/li>\n<li data-end=\"9865\" data-start=\"9510\">Whether there is a political offense or human rights risk<\/li>\n<li data-end=\"9865\" data-start=\"9510\">Whether there is an opportunity for a fair trial in the requesting country<\/li>\n<li data-end=\"9865\" data-start=\"9510\">Whether the person can later withdraw this consent<\/li>\n<li data-end=\"9865\" data-start=\"9510\">Whether there is a possibility of trial in Turkey instead of extradition<\/li>\n<\/ul>\n<p data-end=\"9941\" data-start=\"9867\">For this reason, consent-based extradition is not a matter to be decided hastily.<\/p>\n<h2 data-end=\"9983\" data-section-id=\"bti863\" data-start=\"9943\">Difference Between Deportation and Extradition at the Airport<\/h2>\n<p data-end=\"10145\" data-start=\"9985\">Deportation procedures may also arise for a foreign person arrested at the airport, apart from the extradition process. However, deportation and extradition are not the same legal institution.<\/p>\n<p data-end=\"10390\" data-start=\"10147\">Deportation is an administrative act concerning the removal of a foreigner from Turkey. Extradition, on the other hand, is a judicial cooperation process based on a foreign state\u2019s request to take delivery of a person for the purpose of a criminal investigation, prosecution, or enforcement of a conviction.<\/p>\n<p data-end=\"10628\" data-start=\"10392\">In extradition files, deporting the person should not replace the extradition process. Especially if there is an extradition request from a foreign state concerning the person, the process must be conducted within the scope of Law No. 6706 and the relevant international treaties.<\/p>\n<h2 data-end=\"10688\" data-section-id=\"k0ov41\" data-start=\"10630\">If a Turkish Citizen Is Arrested at the Airport, Can They Be Extradited?<\/h2>\n<p data-end=\"10929\" data-start=\"10690\">As a rule, Turkish citizens cannot be extradited to a foreign country. Therefore, whether a person stopped at the airport due to a Red Notice or foreign state record is a Turkish citizen is one of the first matters to be examined.<\/p>\n<p data-end=\"11187\" data-start=\"10931\">However, this does not mean that no action can be taken against a Turkish citizen. There may be an arrest warrant in Turkey for the person, an investigation may be opened in Turkey based on information received from a foreign country, or judicial assistance mechanisms may be operated.<\/p>\n<p data-end=\"11255\" data-start=\"11189\">For Turkish citizens, the following matters in particular should be examined:<\/p>\n<ul>\n<li data-end=\"11552\" data-start=\"11257\">The person\u2019s citizenship status<\/li>\n<li data-end=\"11552\" data-start=\"11257\">Possibility of dual citizenship<\/li>\n<li data-end=\"11552\" data-start=\"11257\">Date of the offense and the date citizenship was acquired<\/li>\n<li data-end=\"11552\" data-start=\"11257\">The equivalent under Turkish law of the offense alleged in the foreign country<\/li>\n<li data-end=\"11552\" data-start=\"11257\">Whether an investigation or prosecution can be conducted in Turkey<\/li>\n<li data-end=\"11552\" data-start=\"11257\">Whether the foreign state has requested judicial assistance other than extradition<\/li>\n<\/ul>\n<h2 data-end=\"11617\" data-section-id=\"186bued\" data-start=\"11554\">Can an Extradition Request Be Rejected After an Arrest at the Airport?<\/h2>\n<p data-end=\"11793\" data-start=\"11619\">Yes. The fact that an arrest has been made at the airport does not mean that the extradition request will necessarily be accepted. The high criminal court separately examines whether the extradition conditions have been met.<\/p>\n<p data-end=\"11858\" data-start=\"11795\">The main circumstances that may lead to rejection of the extradition request are as follows:<\/p>\n<ul>\n<li data-end=\"12387\" data-start=\"11860\">The person is a Turkish citizen<\/li>\n<li data-end=\"12387\" data-start=\"11860\">The act does not constitute a crime under Turkish law<\/li>\n<li data-end=\"12387\" data-start=\"11860\">The offense is time-barred<\/li>\n<li data-end=\"12387\" data-start=\"11860\">The act is a political offense or an offense connected with a political offense<\/li>\n<li data-end=\"12387\" data-start=\"11860\">The act is a purely military offense<\/li>\n<li data-end=\"12387\" data-start=\"11860\">A decision has previously been rendered in Turkey for the same act<\/li>\n<li data-end=\"12387\" data-start=\"11860\">There is a risk of torture or ill-treatment in the requesting country<\/li>\n<li data-end=\"12387\" data-start=\"11860\">There is a serious risk in terms of the right to a fair trial<\/li>\n<li data-end=\"12387\" data-start=\"11860\">There is a possibility of the death penalty or a punishment incompatible with human dignity<\/li>\n<li data-end=\"12387\" data-start=\"11860\">The extradition documents are incomplete, contradictory, or procedurally unlawful<\/li>\n<\/ul>\n<p data-end=\"12521\" data-start=\"12389\">\n<p data-end=\"12521\" data-start=\"12389\">Therefore, in the process that begins at the airport, the defense should focus not only on the arrest procedure but also on the merits of the extradition request.<\/p>\n<h2 data-end=\"12565\" data-section-id=\"q5e26c\" data-start=\"12523\">What Should a Person Arrested at the Airport Do?<\/h2>\n<p data-end=\"12832\" data-start=\"12567\">A person arrested or detained at the airport should first remain calm and try to learn the reason for the procedure. They should ask which record the procedure is based on and whether the arrest warrant originates from Turkey or from a foreign state\/INTERPOL.<\/p>\n<p data-end=\"12882\" data-start=\"12834\">At this stage, the following points should be considered:<\/p>\n<ul>\n<li data-end=\"13275\" data-start=\"12884\">A lawyer should be requested.<\/li>\n<li data-end=\"13275\" data-start=\"12884\">If an interpreter is needed, this should be clearly stated.<\/li>\n<li data-end=\"13275\" data-start=\"12884\">Documents that are not understood should not be signed.<\/li>\n<li data-end=\"13275\" data-start=\"12884\">No hasty decision should be made regarding consent-based extradition.<\/li>\n<li data-end=\"13275\" data-start=\"12884\">The basis of the Red Notice or diffusion message should be learned.<\/li>\n<li data-end=\"13275\" data-start=\"12884\">The content of the arrest report should be checked.<\/li>\n<li data-end=\"13275\" data-start=\"12884\">If there is a health problem, it should be reported immediately.<\/li>\n<li data-end=\"13275\" data-start=\"12884\">Notification of family or relatives should be requested.<\/li>\n<\/ul>\n<p data-end=\"13434\" data-start=\"13277\">The first hours in airport files are important.
