Detention at the airport and the extradition process may arise especially for persons who are subject to an arrest warrant, an INTERPOL Red Notice, a diffusion message, a restriction record, or an extradition request originating from a foreign state. A person may be stopped at passport control while entering Turkey, leaving Turkey, or during transit.<\/p>\n

In such cases, although the expression \u201cdetention at the airport\u201d is used in practice, the legal process is not always of the same nature. In some files, the person may be subject to an arrest procedure<\/strong>, in some files detention<\/strong>, and in some files provisional arrest for the purpose of extradition<\/strong> or judicial control<\/strong> may arise.<\/p>\n

The existence of a Red Notice or diffusion message does not mean that the person will automatically be arrested or directly extradited to the foreign state. INTERPOL states that a Red Notice is not an international arrest warrant, but a request made to locate a person and provisionally arrest them for the purpose of extradition, surrender, or similar legal action.<\/p>\n

What Is Detention at the Airport?<\/h2>\n

    Are Arrest and Detention at the Airport the Same Thing?<\/h2>\n

    Arrest, detention, and pre-trial detention are different legal procedures. At the airport, a person may first be stopped or arrested by law enforcement. Then, the prosecutor\u2019s office may decide on release, detention, referral to a judicial authority, or another procedure.<\/p>\n
