In Turkish law, this institution is mostly referred to as \u201cextradition\u201d or \u201cthe return of offenders.\u201d<\/p>\n<p data-start=\"380\" data-end=\"834\">In Turkey, extradition is assessed within the framework of Law No. 6706 on International Judicial Cooperation in Criminal Matters, bilateral or multilateral international treaties to which Turkey is a party, the Constitution, and the relevant provisions of criminal procedure. According to the explanations of the Ministry of Justice, extradition is addressed both in terms of extradition from Turkey to a foreign state and Turkey\u2019s extradition requests from foreign states.<\/p>\n<p data-start=\"836\" data-end=\"1125\">The extradition process does not conclude automatically merely because a foreign state has submitted a request. The court examines the legal requirements of the extradition request, the person\u2019s citizenship, the nature of the offense, limitation periods, claims of political offense, human rights risks, and the procedural compliance of the request documents together.<\/p>\n<h2 data-section-id=\"rs1urg\" data-start=\"1127\" data-end=\"1154\">What Is Extradition?<\/h2>\n<p data-start=\"1156\" data-end=\"1352\">Extradition is the process of surrendering a person who is subject to a criminal investigation or prosecution in a foreign country, or who has a final conviction, to the requesting state.<\/p>\n<p data-start=\"1354\" data-end=\"1598\">This process may arise in two ways. In the first situation, a foreign state requests the extradition of a person located in Turkey. In the second situation, Turkey requests the extradition to Turkey of a suspect, defendant, or convicted person located abroad.<\/p>\n<p data-start=\"1600\" data-end=\"1921\">For Turkey, extradition is regulated in the third part of Law No. 6706. The Ministry of Justice states that the procedure for extradition from Turkey to a foreign state is regulated between Articles 10 and 21 of Law No. 6706, while Turkey\u2019s extradition requests are regulated in Article 22.<\/p>\n<h2 data-section-id=\"1y0hob4\" data-start=\"1923\" data-end=\"1962\">What Are the Conditions for Extradition?<\/h2>\n<p data-start=\"1964\" data-end=\"2113\">Certain basic conditions must be met together for extradition. Without these conditions, surrendering a person to a foreign state is not possible.<\/p>\n<p data-start=\"2115\" data-end=\"2147\">The main extradition conditions are as follows:<\/p>\n<ul>\n<li data-start=\"2149\" data-end=\"2664\">The existence of a duly submitted extradition request<\/li>\n<li data-start=\"2149\" data-end=\"2664\">The act subject to the request must be considered a criminal offense under the laws of both countries<\/li>\n<li data-start=\"2149\" data-end=\"2664\">The offense must require a custodial sentence of a certain severity<\/li>\n<li data-start=\"2149\" data-end=\"2664\">There must be no statute of limitations or amnesty bar<\/li>\n<li data-start=\"2149\" data-end=\"2664\">The request must not concern a political offense or a purely military offense<\/li>\n<li data-start=\"2149\" data-end=\"2664\">The person must not be a Turkish citizen<\/li>\n<li data-start=\"2149\" data-end=\"2664\">There must not have been a final judgment in Turkey for the same act<\/li>\n<li data-start=\"2149\" data-end=\"2664\">There must be no risk of torture, ill-treatment, or lack of a fair trial<\/li>\n<\/ul>\n<p data-start=\"2149\" data-end=\"2664\">The request documents must have been prepared in accordance with the law and treaties<\/p>\n<p data-start=\"2666\" data-end=\"3079\">In extradition requests at the investigation or prosecution stage, it is required that the upper limit of the sentence for the offense, under both the law of the requesting state and Turkish law, involve a custodial sentence of a certain severity. In final conviction cases, the sentence imposed must exceed a certain duration. This assessment is made within the scope of the extradition provisions of Law No. 6706.<\/p>\n<h2 data-section-id=\"lf9q0u\" data-start=\"3081\" data-end=\"3104\">Dual Criminality Requirement<\/h2>\n<p data-start=\"3106\" data-end=\"3295\">One of the most important conditions in extradition is the principle of dual criminality. Accordingly, the act subject to the extradition request must constitute a criminal offense under both the law of the requesting state and Turkish law.<\/p>\n<p data-start=\"3297\" data-end=\"3625\">For example, if an act considered a crime in a foreign country is not regulated as a crime under Turkish law, a serious legal obstacle may arise for the extradition request. Therefore, in extradition files, not only the offense classification made by the authorities of the foreign country but also the equivalent of the act under the Turkish Penal Code and relevant special laws must be examined.<\/p>\n<p data-start=\"3627\" data-end=\"3938\">When assessing dual criminality, the name of the offense is not considered decisive; rather, the legal nature and material elements of the act are taken into account. The use of a different offense name in the requesting country does not, by itself, constitute an obstacle to extradition. What matters is whether the alleged conduct is also punishable under Turkish law.<\/p>\n<h2 data-section-id=\"138u8td\" data-start=\"3940\" data-end=\"3968\">Extraditable Offense Requirement<\/h2>\n<p data-start=\"3970\" data-end=\"4231\">Not every offense can be subject to an extradition request. For extradition, the requested act must be an offense of a certain seriousness. Some minor acts, administrative sanctions, or matters arising solely from private law disputes may not be assessed within the scope of extradition.<\/p>\n<p data-start=\"4233\" data-end=\"4299\">The following points are taken into account when assessing an extraditable offense:<\/p>\n<ul>\n<li data-start=\"4301\" data-end=\"4599\">The severity of the penalty prescribed for the offense<\/li>\n<li data-start=\"4301\" data-end=\"4599\">Whether the act is considered a crime in both countries<\/li>\n<li data-start=\"4301\" data-end=\"4599\">Whether the offense is political or military in nature<\/li>\n<li data-start=\"4301\" data-end=\"4599\">Whether the act is a private law dispute or a criminal law violation<\/li>\n<li data-start=\"4301\" data-end=\"4599\">The sufficiency of the documents submitted by the requesting state<\/li>\n<li data-start=\"4301\" data-end=\"4599\">Whether the offense is time-barred<\/li>\n<\/ul>\n<p data-start=\"4601\" data-end=\"4895\">In particular, economic crimes, fraud, money laundering, drug offenses, organized crimes, homicide, sexual offenses, terrorism offenses, or other acts requiring severe penalties may frequently arise in extradition files. However, the nature of the offense and the extradition conditions must be examined separately in each file.<\/p>\n<h2 data-section-id=\"xras8q\" data-start=\"4897\" data-end=\"4937\">Can Turkish Citizens Be Extradited?<\/h2>\n<p data-start=\"4939\" data-end=\"5243\">As a rule, Turkish citizens cannot be extradited to a foreign country. According to Article 38 of the Constitution of the Republic of Turkey, except for obligations arising from being a party to the International Criminal Court, a citizen cannot be surrendered to a foreign country on account of an offense.<\/p>\n<p data-start=\"5245\" data-end=\"5564\">For this reason, the fact that the person whose extradition is requested is a Turkish citizen is one of the most important grounds for refusal in the extradition process. However, citizenship status must be examined concretely in each file. Dual citizenship, the date citizenship was acquired, the date of the offense, the date of the extradition request, and the person\u2019s civil registry records are important in this assessment.<\/p>\n<p data-start=\"5566\" data-end=\"5792\">If a Turkish citizen is alleged to have committed an offense abroad, different legal avenues may arise instead of extradition, such as conducting an investigation or prosecution in Turkey, judicial assistance, evidence sharing, or transfer of proceedings.<\/p>\n<h2 data-section-id=\"yob7ub\" data-start=\"5794\" data-end=\"5832\">Cases in Which an Extradition Request Will Be Rejected<\/h2>\n<p data-start=\"5834\" data-end=\"6001\">Law No. 6706 separately regulates the circumstances in which an extradition request will not be accepted. If these circumstances exist, the court may not find the extradition request admissible.<\/p>\n<p data-start=\"6003\" data-end=\"6061\">The main circumstances in which an extradition request may be rejected are as follows:<\/p>\n<ul>\n<li data-start=\"6063\" data-end=\"6728\">The person whose extradition is requested is a Turkish citizen<\/li>\n<li data-start=\"6063\" data-end=\"6728\">The person is at risk of being punished because of their race, ethnic origin, religion, nationality, social group, or political opinion<\/li>\n<li data-start=\"6063\" data-end=\"6728\">There is a risk of torture or ill-treatment in the requesting state<\/li>\n<li data-start=\"6063\" data-end=\"6728\">The act is a thought offense, a political offense, or an offense connected with a political offense<\/li>\n<li data-start=\"6063\" data-end=\"6728\">The act is purely military in nature<\/li>\n<li data-start=\"6063\" data-end=\"6728\">The act is an offense falling within Turkey\u2019s jurisdiction<\/li>\n<li data-start=\"6063\" data-end=\"6728\">The offense has become time-barred or has been subject to amnesty<\/li>\n<li data-start=\"6063\" data-end=\"6728\">There has previously been an acquittal or conviction in Turkey for the same act<\/li>\n<\/ul>\n<p data-start=\"6063\" data-end=\"6728\">The request concerns an offense requiring the death penalty or a punishment incompatible with human dignity<\/p>\n<p data-start=\"6730\" data-end=\"7120\">Law No. 6706 also provides that, in cases where there is a risk of the death penalty or a punishment incompatible with human dignity, the extradition request may be assessed separately if sufficient assurances are provided by the requesting state. In addition, the law states that during the extradition process, the foreign national cannot be deported without obtaining the opinion of the Central Authority.<\/p>\n<h2 data-section-id=\"1erhk8h\" data-start=\"7122\" data-end=\"7150\">Extradition on Grounds of Political Offense<\/h2>\n<p data-start=\"7152\" data-end=\"7387\">In extradition law, an allegation of political offense is an important ground for refusal. If there is serious suspicion that a person will be punished because of their political views, opposition identity, ethnic origin, or membership in a social group, the extradition request may not be accepted.<\/p>\n<p data-start=\"7389\" data-end=\"7705\">However, not every political claim automatically creates an obstacle to extradition. The court evaluates the nature of the act subject to the request, the manner in which it was committed, the means used, the resulting consequences, and the seriousness of the offense. Acts involving serious violence, crimes against humanity, or crimes such as genocide may not be accepted within the scope of political offenses.<\/p>\n<p data-start=\"7707\" data-end=\"7883\">Therefore, a political offense defense should be supported not by abstract allegations, but by concrete documents, country reports, judicial practice, the person\u2019s background, and the risks in the requesting state.<\/p>\n<h2 data-section-id=\"1g3g7cj\" data-start=\"7885\" data-end=\"7910\">Statute of Limitations and Amnesty Requirement<\/h2>\n<p data-start=\"7912\" data-end=\"8107\">If the offense subject to the extradition request is time-barred under Turkish law or the law of the requesting state, the extradition request may be rejected. Likewise, the act being subject to amnesty may also constitute an obstacle to extradition.<\/p>\n<p data-start=\"8109\" data-end=\"8358\">The statute of limitations assessment must be made separately in each file. This is because the criminal limitation rules of the requesting country and the limitation periods under Turkish law may differ. In addition, acts that interrupt or suspend the limitation period must also be examined specifically within the file.<\/p>\n<p data-start=\"8360\" data-end=\"8547\">For this reason, in an extradition request, not only the date of the offense but also the arrest warrant, indictment, conviction judgment, enforcement process, and limitation provisions of the requesting state must be assessed together.<\/p>\n<h2 data-section-id=\"v9vrws\" data-start=\"8549\" data-end=\"8596\">Prior Decision Rendered for the Same Act<\/h2>\n<p data-start=\"8598\" data-end=\"8766\">If the person whose extradition is requested has previously been acquitted or convicted in Turkey for the same act, this is important for the rejection of the extradition request.<\/p>\n<p data-start=\"8768\" data-end=\"9086\">This principle aims to prevent the same person from being tried or punished again for the same act. However, the important point here is whether the prior decision actually relates to the same act. Even if the name of the offense is different, if the incident, victim, date, act, and legal subject matter are the same, this point may be raised in the extradition defense.<\/p>\n<h2 data-section-id=\"1fcvsqq\" data-start=\"9088\" data-end=\"9118\">Human Rights Risk and Extradition<\/h2>\n<p data-start=\"9120\" data-end=\"9378\">In extradition files, not only the existence of the offense but also the treatment the person will face in the requesting state is important. If there is a risk of torture, ill-treatment, punishment incompatible with human dignity, lack of a fair trial, or discriminatory prosecution, the extradition request may be rejected.<\/p>\n<p data-start=\"9380\" data-end=\"9627\">Such allegations must be made concrete in order to be effective. Prison conditions in the requesting country, access to an independent court, the right to defense, allegations of political pressure, health conditions, and the person\u2019s individual circumstances must be assessed together.<\/p>\n<p data-start=\"9629\" data-end=\"9812\">In particular, personal circumstances such as serious illness, advanced age, family ties, living in Turkey for a long time, or the situation of children may also be important for the proportionality of the extradition decision.<\/p>\n<h2 data-section-id=\"16gccp7\" data-start=\"9814\" data-end=\"9849\">Is a Red Notice a Condition for Extradition?<\/h2>\n<p data-start=\"9851\" data-end=\"10262\">A red notice may be connected with the extradition process; however, it is not an extradition decision by itself. According to INTERPOL, a red notice is a request to law enforcement authorities to locate a person and provisionally arrest them for the purpose of extradition, surrender, or similar legal action. INTERPOL also clearly states that a red notice is not an international arrest warrant.<\/p>\n<p data-start=\"10264\" data-end=\"10513\">Therefore, the arrest in Turkey of a person who is the subject of a red notice does not mean that the person will automatically be surrendered to the foreign state. Extradition proceedings are also conducted in Turkey, and the court assesses whether the extradition conditions are met.<\/p>\n<p data-start=\"10515\" data-end=\"10586\">In files involving a red notice, the following matters in particular should be examined:<\/p>\n<ul>\n<li data-start=\"10588\" data-end=\"10900\">The arrest warrant on which the notice is based<\/li>\n<li data-start=\"10588\" data-end=\"10900\">The criminal allegation submitted by the requesting country<\/li>\n<li data-start=\"10588\" data-end=\"10900\">The equivalent of the act under Turkish law<\/li>\n<li data-start=\"10588\" data-end=\"10900\">Whether the extradition documents arrived within the required period<\/li>\n<li data-start=\"10588\" data-end=\"10900\">Whether provisional arrest is proportionate<\/li>\n<li data-start=\"10588\" data-end=\"10900\">Whether there is a political offense or human rights risk<\/li>\n<li data-start=\"10588\" data-end=\"10900\">Whether the notice complies with INTERPOL rules<\/li>\n<\/ul>\n<h2 data-section-id=\"1nxsqd\" data-start=\"10902\" data-end=\"10937\">Provisional Arrest and Judicial Control<\/h2>\n<p data-start=\"10939\" data-end=\"11236\">A provisional arrest order may be issued against the person during the extradition process. However, arrest is not a measure to be applied automatically. The court must assess the person\u2019s risk of flight, the nature of the alleged offense, the status of the extradition documents, fixed residence, family ties, and health condition together.<\/p>\n<p data-start=\"11238\" data-end=\"11447\">Judicial control measures may also be applied instead of arrest. In this context, measures such as a ban on leaving the country, an obligation to sign in at regular intervals, residing at a specified address, or providing security may come into consideration.<\/p>\n<p data-start=\"11449\" data-end=\"11639\">In extradition files, the proportionality of the arrest measure is particularly important. In this process, which directly affects the person\u2019s liberty, an effective objection to the provisional arrest order may be necessary.<\/p>\n<h2 data-section-id=\"1d37w7g\" data-start=\"11641\" data-end=\"11679\">Competent Court in Extradition Proceedings<\/h2>\n<p data-start=\"11681\" data-end=\"11873\">In Turkey, the high criminal court of the place where the person is located is competent to decide on the extradition request. If the person\u2019s location is not known, jurisdiction is assessed according to the relevant legal provisions.<\/p>\n<p data-start=\"11875\" data-end=\"12107\">The high criminal court examines whether the extradition request is admissible. In this examination, the court evaluates the documents of the requesting state, the person\u2019s defense, the nature of the offense, grounds for refusal, and fundamental rights risks together.<\/p>\n<p data-start=\"12109\" data-end=\"12306\">Even if the court finds the extradition request admissible, this decision does not mean that the person will be surrendered immediately. After the judicial stage, an administrative approval and surrender stage may also arise in the extradition process.<\/p>\n<h2 data-section-id=\"dyba8f\" data-start=\"12308\" data-end=\"12348\">How Does the Extradition Process Work?<\/h2>\n<p data-start=\"12350\" data-end=\"12410\">The extradition process generally consists of the following stages:<\/p>\n<ul>\n<li data-start=\"12412\" data-end=\"12973\">The foreign state prepares the extradition request<\/li>\n<li data-start=\"12412\" data-end=\"12973\">The request is transmitted to Turkey through diplomatic channels or the central authority<\/li>\n<li data-start=\"12412\" data-end=\"12973\">A preliminary review is conducted by the Ministry of Justice<\/li>\n<li data-start=\"12412\" data-end=\"12973\">If documents are missing, additional information or documents are requested<\/li>\n<li data-start=\"12412\" data-end=\"12973\">The file is sent to the competent chief public prosecutor\u2019s office<\/li>\n<li data-start=\"12412\" data-end=\"12973\">Extradition proceedings are conducted before the high criminal court<\/li>\n<li data-start=\"12412\" data-end=\"12973\">The court decides whether the extradition request is admissible<\/li>\n<li data-start=\"12412\" data-end=\"12973\">Legal remedies against the decision are evaluated<\/li>\n<li data-start=\"12412\" data-end=\"12973\">If the acceptance decision becomes final, the administrative approval process is carried out<\/li>\n<\/ul>\n<p data-start=\"12412\" data-end=\"12973\">Surrender procedures are performed<\/p>\n<p data-start=\"12975\" data-end=\"13278\">According to the explanations of the Ministry of Justice, in extradition proceedings, in addition to Law No. 6706, bilateral or multilateral treaties in force with the relevant states are taken into account; in cases where there is no treaty, international customary law and the principle of reciprocity are considered.<\/p>\n<h2 data-section-id=\"1kbswz7\" data-start=\"13280\" data-end=\"13317\">Are Deportation and Extradition the Same Thing?<\/h2>\n<p data-start=\"13319\" data-end=\"13642\">Deportation and extradition are not the same legal institution. Deportation is an administrative act concerning the removal of a foreign national from Turkey. Extradition, on the other hand, is a special judicial cooperation process in which a foreign state requests the person\u2019s surrender for the purpose of a criminal investigation, prosecution, or enforcement of a final conviction.<\/p>\n<p data-start=\"13644\" data-end=\"13984\">While the extradition process is ongoing, deporting the person is subject to special rules. Law No. 6706 provides that during the extradition process, a foreign national cannot be deported without obtaining the opinion of the Central Authority. In addition, deportation to a state whose extradition request has been rejected cannot be carried out without obtaining the opinion of the Central Authority.<\/p>\n<p data-start=\"13986\" data-end=\"14182\">Therefore, if there is a deportation decision, restriction code, administrative detention, or residence permit issue in extradition files, foreign nationals law and administrative law applications should also be assessed together with the extradition process.<\/p>\n<h2 data-section-id=\"1jw5yi9\" data-start=\"14184\" data-end=\"14222\">Legal Support in Extradition of Offenders<\/h2>\n<p data-start=\"14224\" data-end=\"14488\">Extradition files are files that directly affect personal liberty and often require swift action.
